McFadyen Bill: Water Quality Matters
Representative Buffie McFadyen’s HB1352 focuses on water quality. Currently, judges must consider who might be harmed by a water transfer or diversion, but the law doesn’t take into account what environmental harm diverting water from a river basin might have on downstream users. McFadyen’s proposal gives judges the discretion to consider water quality impacts from changes of use, such as from agriculture to municipal water.
